Terms and Conditions

MIDDLE DECK BOOKING TERMS AND CONDITIONS

Booking Form

Before completing the Booking Form please read these booking terms and conditions.

To confirm your booking you must complete our Booking Form online, and make any requested initial payment within 7 days of making your provisional booking. We cannot hold your provisional booking beyond that time limit.

The person completing the Booking Form is responsible for making the payments when due.

Payment

For bookings made less than 2 months before your holiday start date, please pay the full amount plus £100 damage deposit (as a separate cheque).

For a booking made more than 2 months before your holiday start date, please provide a deposit of 25% of the rental cost. The balance plus the damage deposit is then due one month prior to the holiday start date. Non-payment by the due date may be treated as a cancellation.

Payments may be by cheque made payable to “Mr & Mrs R Jones”, or by direct bank transfer. We will provide our bank details on request.

Refundable Damage Deposit

All bookings are accepted on the condition that the property is left clean and tidy and that breakages or damage will be paid for by the person who signed the Booking Form. The damage deposit less the cost of any damages will be returned to you within four weeks of your departure or we will notify you of any further payment due.

Guests

The maximum capacity of the property is 4 persons in 2 bedrooms – one double room and one twin room.

We do not accept bookings for single sex groups of more than two persons unless the group are members of the same family, across different generations.

The person completing the Booking Form must be at least 18 years of age.

The property may not be occupied by persons other than those named on the Booking Form.

Linen

The property is equipped with bed linen including sheets, duvets, duvet covers, pillows and pillow cases.  We also provide tea towels and personal towels, but not beach towels.

The beds will be made prior to your arrival. If you are staying for two or more weeks, we will arrange for a change of linen. You are responsible for making the beds during your holiday.

Gas, Electricity and WiFi

The rental cost is inclusive of all gas, electricity, and internet connection.

Occupation Times

Your hire commences after 4pm on the start date of your booking and terminates at 9am on the end date of your booking. You may not enter the property before 4pm on the commencement date under any circumstances, and the property must be vacated by 9am on the termination date. You will be liable for any cost of whatever nature incurred because of an unauthorised continued occupation of the property.

Neighbours

You agree that all members of your party will not cause an annoyance or become a nuisance to occupants of the neighbouring properties.

Pets and Smoking

The property does not accept pets and is strictly non-smoking.

Personal belongings

Baggage and personal belongings are brought into the property at your risk and no responsibility can be accepted for loss of or damage to such items. We strongly recommend that you take out insurance to cover events such as losses, theft, or damage to personal belongings.

Cancellation

In the event of a cancellation being received in writing, we will endeavour to re-let the property and, if successful, will refund any monies already paid less an administration charge of £30.  If the property is not re-let for any reason, you will be liable for the whole of the rental amount. A booking can only be cancelled prior to the commencement of your booking.

Changing a Booking

If you wish to change the booking, then subject to availability we will change the dates of the booking at an administration charge of £30. We will either request immediate payment of the outstanding balance or refund any outstanding balance against the tariff published on the website.

Availability

This Agreement is made on the understanding that the property will be available for the dates stated.  In the unlikely event that the property is not available through events beyond our control, we may be forced to cancel your booking.  We will advise you of such circumstances as soon as possible, refund all monies paid in full, and you will have no further claims against us.

Data and Privacy

When you make a booking we will ask you for personal information including your name, address, telephone number and email address. We will not pass your information to third parties. From time to time we may use the data to inform you about news or information that we think may interest you. You will be able to unsubscribe from our email list.

Complaints

If you feel you have grounds for complaint during your holiday, then you agree to contact us as soon as the problem arises. We will take all reasonable steps to resolve the issue as quickly as possible. We cannot accept complaints after the termination of your holiday.

Website Description

We have made all reasonable efforts to accurately describe Middle Deck on our website and cannot accept responsibility for errors. You accept that minor differences may arise between the description and the actual property.

Price Changes

We reserve the right to amend prices quoted due to errors or omissions. We will notify you of any such change as soon as possible, and you will be able to cancel without penalty if the amended price is significantly higher than the original quote.

Right of Entry

We or our representative shall be allowed access to the property at any reasonable time during your holiday occupancy.

Right to Evict

We reserve the right to evict you and your party without compensation if this action is deemed necessary. Reasons could include anti-social behaviour, unreasonable breakages or damage, or a material breach of this Agreement.

Liability

We do not accept any liability for accident, injury, loss, or expense, whether to property or persons, that you may suffer or incur in any way connected to the letting.

No Tenancy

This Agreement only confers the right to occupy our property for a holiday. You shall not be entitled to any assured shorthold or assured tenancy or any statutory protection under the Housing Act 1988 or other security of tenure now or on termination of the hire.

Disputes and Governing Law

By entering into this Agreement both parties agree to make reasonable efforts to resolve any disputes in an amicable manner.  If necessary, both parties submit to the jurisdiction of the courts of England. In the event that a court finds a condition in this Agreement to be illegal or void, that provision will be severed from the remaining terms and conditions which will continue to be valid and enforceable.
